The New Aged Care Act 2024, which commenced on
1 November 2025, represents a major reform to Australia’s aged care system, in response to the Royal Commission into Aged Care Quality and Safety.

The Act ties building maintenance to the strengthened Aged Care Quality Standards (particularly Standard 4: The Environment), requiring facilities to provide safe, dignified, and supportive physical spaces.

While not prescribing specific building codes, it influences design and upkeep to align with resident rights, quality care, and audit compliance. Facilities must go beyond minimum National Construction Code requirements to support ongoing operations, accreditation, and risk reduction.

There is an enhanced focus on fire safety, accessibility (e.g., for mobility aids), infection control (e.g., ventilation), and environmental maintenance to prevent harm. Buildings must facilitate 24/7 care delivery, including spaces for staff and technology integration (e.g., remote monitoring, electronic records). Regular upgrades are needed to maintain compliance during audits, yet disruptions must be minimised to avoid impacting residents.

Facilities will require secure IT systems for digital compliance and care tools. Smaller or regional buildings may need targeted upgrades to meet liquidity-linked standards or avoid closures. Poor maintenance could lead to non-compliance penalties, as buildings must demonstrably support the Statement of Rights and prevent unsafe conditions.
